The Fair Work Commission and Intractable Bargaining Determination

Any EA negotiation presents a number of decisions to be made by the company, AIPA and members to determine the final outcome.

One aspect of this may involve the Fair Work Commission and the potential for a negotiation reaching an Intractable Bargaining Determination or IBD.

To provide our members with a better understanding of the role of the FWC and the pros and cons of proceeding with an IBD, I sat down with Matt Warburton, AIPA's head of legal and chatted about this pathway. Matt has more than 30 years of experience in industrial relations, so his perspective and expertise in this area is valuable.
